1. Rental Agreement & Parties

This Rental Agreement ("Agreement") is entered into between Justis Rentals ("Owner") and the individual signing below ("Renter"). By signing, the Renter agrees to rent the personal watercraft (jet ski) and related equipment identified at check-in, subject to all terms of this Agreement. The Renter must be at least 18 years of age and present a valid government-issued photo ID at check-in. This Agreement covers the Renter and every guest or passenger in the Renter's party.

2. Rental Period & Return

The watercraft is rented for the specific time period reserved and confirmed at booking. The Renter agrees to return the watercraft to the designated location at or before the scheduled end time. LATE RETURNS are charged at the Owner's posted hourly rate, and watercraft not returned within a reasonable time may be reported as stolen. The rental period begins at the scheduled start time whether or not the Renter arrives on time; no refund is given for late arrival or early return.

3. Fuel

Fuel is included in the rental price for normal recreational use during the reserved period. The Renter agrees not to tamper with, siphon, or misuse the fuel system, and to only use the watercraft during the paid rental window. The Renter is responsible for any fuel-system damage caused by improper use.

4. Security Deposit & Payment Authorization

A refundable security deposit may be required at check-in and held against damage, loss, late return, cleaning, or violations of this Agreement. The Renter authorizes Justis Rentals to charge the payment method on file for: the rental price; any damage to or loss of the watercraft, trailer, or equipment; late-return fees; excessive cleaning; recovery or towing costs; fines or citations issued during the rental; and any other charges permitted under this Agreement. The deposit will be refunded, less any such charges, after the equipment is inspected and returned in acceptable condition.

5. Prohibited Uses

The Renter agrees NOT to: operate the watercraft under the influence of alcohol, marijuana, or any drug; permit anyone not listed on this Agreement or not authorized by the Owner to operate the watercraft; operate recklessly, jump wakes dangerously, or endanger others; tow any person or object; carry more passengers than the manufacturer's rated capacity; operate outside the designated lake or permitted areas, in restricted or no-wake zones, or after dark; race or use the watercraft for any commercial purpose; or remove the watercraft from the body of water where it was launched. Violation of any prohibited use immediately terminates this Agreement and may result in forfeiture of the deposit and all fees.

6. Operator & Passenger Requirements

Every operator must meet the minimum age and any boater-education or licensing requirements under California law and must complete the mandatory safety briefing before operating. A U.S. Coast Guard-approved life jacket must be worn by every operator and passenger at all times on the water. The Renter is responsible for ensuring every member of the party understands and follows all safety instructions and rules provided by the Owner.

7. Cancellation, Weather & Right to Refuse or Terminate

Cancellation and rescheduling are subject to the Owner's posted policy. The Owner may cancel or shorten a rental due to unsafe weather, water, or lake conditions, mechanical issues, or events beyond its control, in which case the Renter's sole remedy is a reschedule or prorated refund at the Owner's discretion. The Owner reserves the right to REFUSE rental to, or immediately TERMINATE the rental of, any person who appears impaired, unfit, or unsafe, or who violates this Agreement, WITHOUT REFUND.

8. Assumption of Risk

I understand that the rental and operation of a personal watercraft (jet ski) is a HAZARDOUS ACTIVITY that involves inherent and serious risks, including but not limited to: collision with other watercraft, swimmers, fixed or floating objects; capsizing; falling off; being thrown from the watercraft; drowning; hypothermia; equipment failure; changing and unpredictable water, weather, wind, and current conditions; the actions of other people; and my own actions or inactions. I knowingly and voluntarily ASSUME ALL RISKS, both known and unknown, of personal injury, death, or property damage arising from this activity, even if caused in whole or in part by the negligence of Justis Rentals.

9. Release and Waiver of Liability

In consideration of being permitted to rent and operate the watercraft, I, on behalf of myself, my heirs, family, assigns, and personal representatives, hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE Justis Rentals, its owners, employees, agents, and affiliates (the "Released Parties") from any and all liability, claims, demands, lawsuits, or causes of action for any loss, damage, personal injury, or death sustained by me or any guest in my party, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

10. Indemnification

I agree to INDEMNIFY, DEFEND, and HOLD HARMLESS the Released Parties from any and all claims, actions, suits, costs, expenses, damages, and attorney's fees brought by me or any third party (including any guest, passenger, or person injured by my operation of the watercraft) arising out of or related to my rental and use of the watercraft.

11. Responsibility for Equipment Damage

I understand that I am PERSONALLY AND FINANCIALLY RESPONSIBLE for any and all loss of or damage to the rented watercraft, trailer, safety equipment, and any related property that occurs during my rental period, regardless of cause, including damage caused by my negligence, misuse, grounding, collision, or operation contrary to instructions. I agree to pay the full cost of repair or replacement, plus any loss-of-use charges, and authorize charges to my payment method on file for such amounts.

12. Safe and Lawful Operation

I certify that I will operate the watercraft in a safe, lawful, and responsible manner; that I will obey all U.S. Coast Guard, California State Parks, and local boating laws and regulations; that I will not operate the watercraft while under the influence of alcohol or drugs; that I will wear a U.S. Coast Guard-approved life jacket at all times; and that all operators and passengers meet the minimum age and any licensing or boater-education requirements under California law.

13. Physical Condition and Safety Briefing

I certify that I (and each member of my party) am in good physical health, am not pregnant, and have no medical condition that would be aggravated by this activity or that would impair my ability to operate the watercraft safely. I acknowledge that I am required to attend and complete the mandatory safety briefing before operating the watercraft.

14. Insurance

I understand that Justis Rentals does NOT provide any medical, accident, or liability insurance covering me or my party, and that I am responsible for my own insurance coverage. Any medical treatment I receive will be at my own expense.

15. Governing Law and Severability

This agreement is governed by the laws of the State of California. If any portion of this agreement is held to be invalid or unenforceable, the remainder shall continue in full force and effect. I agree that this is intended to be as broad and inclusive as permitted by California law.

16. Designated Docking Only

I agree that the watercraft may only be docked, beached, or moored at DESIGNATED DOCKS. Docking, landing, or beaching on any island or other non-designated area is STRICTLY PROHIBITED unless I have obtained prior permission from Justis Rentals. I understand that improper docking may cause hull, propulsion, or other damage, and I accept full financial responsibility for any damage, recovery, or loss-of-use costs resulting from docking in a prohibited or non-designated location, and authorize Justis Rentals to charge the payment method on file for such amounts.

17. Capsize & Engine Flooding Charge

I understand that if the watercraft is flipped or capsized, it MUST be rolled back upright within 90 SECONDS to prevent water from entering and flooding the engine. I acknowledge that if the watercraft is not righted within 90 seconds and the engine will not start as a result, this constitutes engine flooding damage caused by my operation, and I agree to a MINIMUM MANDATORY CHARGE OF $2,000 for engine-flooding damages, in addition to any further repair, replacement, recovery, or loss-of-use costs. I authorize Justis Rentals to charge the payment method on file for this amount.

18. Audio Speaker Water Damage

I understand that the watercraft may be equipped with an audio speaker system that is susceptible to water intrusion. I acknowledge that if the watercraft is flipped or capsized and the speaker system sustains water damage as a result, this constitutes damage caused by my operation, and I agree to a MINIMUM MANDATORY CHARGE OF $250 for speaker water damage, in addition to any further repair, replacement, or loss-of-use costs. I authorize Justis Rentals to charge the payment method on file for this amount.

19. Acknowledgment

I HAVE CAREFULLY READ THIS RENTAL AGREEMENT AND WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS CONTENTS, AND AM AWARE THAT BY SIGNING IT ELECTRONICALLY I AM ENTERING INTO A BINDING CONTRACT AND GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
